Please read this Disclaimer carefully before using socialwatch.ai (“SocialWatch,” “we,” “us,” or “our”), including our website, applications, and any related services (collectively, the “Platform”). By accessing or using the Platform, you acknowledge that you have read, understood, and agree to this Disclaimer. If you do not agree, do not use the Platform.
This Disclaimer supplements, and is incorporated by reference into, our Terms and Conditions and Privacy Policy. In the event of any conflict, those documents govern.
1. Informational Purpose Only
1.1. The Platform analyzes the publicly available content of the accounts followed by a person who has accepted an invitation and chosen to share the accounts they follow, and turns it into a readable assessment of the digital environment that surrounds them. Everything the Platform produces — every report, score, tag, label, and insight — is provided for general informational and educational purposes only.
1.2. The Platform is a research and conversation tool. It is intended to be a starting point for awareness and an honest conversation — never a verdict, diagnosis, or final conclusion about any person.
2. Not Professional Advice
2.1. The Platform does not provide medical, mental-health, psychological, legal, financial, safety, or any other professional advice, and nothing it produces should be treated as such.
2.2. The Platform is not a substitute for professional, clinical, legal, or medical judgment. If you have concerns — for example about self-harm, eating disorders, hate, harassment, addiction, or radicalization — please consult a qualified professional (such as a mental-health provider, family doctor, or legal advisor) or contact the appropriate helpline. Never disregard professional advice or delay seeking it because of something you read in a report.
2.3. If you believe someone is in immediate danger, contact your local emergency services right away.
3. AI-Generated Analysis and Accuracy
3.1. The Platform uses Artificial Intelligence, including large language models accessed through standard commercial APIs from third-party providers, to read and classify publicly available content. AI systems are imperfect: they can produce false positives, miss context, and misread nuance, irony, sarcasm, and intent.
3.2. We do not guarantee the accuracy, completeness, timeliness, or reliability of any report or insight. Results may be incomplete or out of date, and the public content available about any account can change at any time.
3.3. You should always review the underlying public content for yourself before drawing any conclusion. Any reliance you place on AI-generated insights is strictly at your own risk.
4. Public Information Only
4.1. The Platform reads only content that the relevant account owner has chosen to make public. The accounts we analyze are identified from the list of accounts the invited person has voluntarily chosen to share; from that list we read only public content. We do not log into anyone's account, we do not store credentials, we do not send follow requests, we do not bypass any login wall, and we do not access private accounts, direct messages, non-public stories, drafts, saved items, location history, or any other content that requires authentication. Raw public content is used only in the moment to extract signals and is not retained.
4.2. The Platform does not perform facial recognition, biometric inference, or photo-based identification. Analysis is based on text and metadata only.
5. No Affiliation With Social Media Platforms
5.1. SocialWatch is an independent service. We are not affiliated with, endorsed by, sponsored by, or operated by Meta Platforms, Instagram, Facebook, TikTok, X (Twitter), or any other social media platform, and we have no special API relationship with any of them.
5.2. All trademarks, logos, and brand names are the property of their respective owners and are referenced for identification purposes only.
6. Not a Consumer Report (FCRA)
6.1. SocialWatch is not a consumer reporting agency as defined by the U.S. Fair Credit Reporting Act (15 U.S.C. § 1681 et seq.) (“FCRA”), and our reports are not “consumer reports” under the FCRA.
6.2. You may not use the Platform or any report it generates, in whole or in part, to make or inform any decision regarding employment, hiring, firing, promotion, demotion, compensation, tenancy, credit, insurance, immigration, education admission, child custody, criminal justice, or any other decision that produces a legal or similarly significant effect on the subject. For any such purpose, you must use a properly regulated background-check or consumer-reporting provider instead.
7. No Automated Decision-Making
7.1. The reports are descriptive analyses, not automated decisions. The Platform does not make decisions about people, and it must not be used as part of any process that produces legal or similarly significant effects on a person without meaningful human review.
7.2. Any human who acts on a report is solely responsible for the decision they make and is the controller of that decision under applicable data-protection law.
8. About the Environment, Not the Person
8.1. The reports describe the digital environment that surrounds a subject — the public content of the accounts the subject follows. They do not, and are not designed to, describe, judge, or profile the subject themselves.
8.2. The presence of any tag, signal, or score reflects content found in a public feed; it is not a statement of fact about the character, beliefs, health, or behavior of any individual.
9. Acceptable Use and Your Responsibility
9.1. The Platform is provided for lawful, personal and family awareness — for example, making sense of your own online environment, or, when someone has invited you in, helping a parent or guardian, friend, or mentor understand the online environment that surrounds a person they care about.
9.2. You are solely responsible for how you use the Platform and any report it generates, including ensuring that your use complies with all applicable laws and with our Terms and Conditions. Do not use the Platform to shame, punish, harass, stalk, defame, threaten, discriminate against, unlawfully monitor, or otherwise harm any person.
9.3. You are responsible for verifying any information and for any action you take based on it.
9.4. Organizational Use. Where the Platform is used by or on behalf of any organization or other entity (including any company, institution, agency, association, group, or team), reports may not be used to make, inform, or serve as a factor in any decision about an individual — including any disciplinary, academic, admissions, enrollment, eligibility, membership, employment, promotion, demotion, compensation, benefits, ranking, or other punitive or adverse decision, or any decision that produces a legal or similarly significant effect on that person. Reports are for awareness and supportive conversation only, always require meaningful and independent human judgment, and must never be used to penalize, exclude, rank, or pass judgment on any individual.
10. No Warranties and Limitation of Liability
10.1. The Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.
10.2. To the maximum extent permitted by applicable law, SocialWatch and its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of, or inability to use, the Platform or any report it generates. Further limitations are set out in our Terms and Conditions.
11. Third-Party Links and Services
11.1. The Platform may reference or link to third-party websites, services, helplines, or resources. We do not control, endorse, or assume responsibility for any third-party content, products, or services, and we provide such references for convenience only.
12. Changes to This Disclaimer
12.1. We may update this Disclaimer from time to time. We will post the revised version on the Platform and update the “Last Updated” date above. Your continued use of the Platform after any change constitutes your acceptance of the updated Disclaimer.
